Welcome to Tuskari. These Terms and Conditions govern your use of our platform and the booking of safari experiences through our marketplace.

By accessing or using Tuskari, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our platform.


1. About Tuskari

1.1 What We Do

Tuskari is a direct safari booking marketplace that connects travelers with verified safari operators across Africa. We provide the infrastructure and platform that enables direct relationships between travelers and operators.

1.2 What We Are Not

Tuskari is not a tour operator, travel agency, or safari reseller. We do not operate safaris, own accommodations, or provide on-ground services. All safari experiences are provided directly by independent operators who list their offerings on our platform.

1.3 Our Role

We facilitate bookings, process payments, and provide customer support, but the contractual relationship for the safari experience itself is between you (the traveler) and the operator.


2. Booking Types

2.1 Instant Booking

Some safaris are available for instant booking. When you complete an instant booking:

   • Your booking is confirmed immediately upon payment

   • The operator commits to providing the safari as described

   • All standard terms, including cancellation policies, apply

2.2 Enquiry Flow Booking

Some safaris require operator confirmation before booking. In this case:

   • You submit an enquiry with your travel dates, guest count, and requirements

   • The operator reviews your request and responds with a personalized quote

   • You can accept or decline the quote

   • Upon acceptance and payment, your booking is confirmed

2.3 Messaging

For both booking types, you can communicate directly with operators through our messaging system before, during, and after the booking process.


3. Pricing and Payment

3.1 Displayed Prices

All prices displayed on Tuskari are shown in US Dollars (USD) and represent the total amount you will pay. This price includes:

   • The safari experience as described by the operator

   • A conservation and local community contribution that supports sustainable tourism practices

3.2 What's Included

The specific inclusions for each safari are detailed on the safari listing page. Please review carefully before booking. Typical inclusions may include accommodation, meals, park fees, game drives, and transfers as specified by the operator.

3.3 What's Not Included

Unless explicitly stated, prices typically do not include:

   • International flights

   • Travel insurance

   • Visa fees

   • Tips and gratuities

   • Personal expenses

   • Optional activities not listed in the itinerary

   • Alcoholic beverages (unless specified)

3.4 Payment Structure

When you book a safari through Tuskari:

   • Deposit: A 30% deposit is required at the time of booking to secure your reservation

   • Balance: The remaining 70% is due 30 days before your safari start date

You can choose to pay the full amount at the time of booking if you prefer

3.5 Payment Processing

All payments are processed securely through Tuskari's payment system. We accept major credit and debit cards. Your payment information is encrypted and handled in accordance with industry security standards.

3.6 Failed Payments

If your balance payment fails or is not received 30 days before your safari start date, your booking may be cancelled, and standard cancellation terms will apply.


4. Cancellations and Refunds

4.1 Standard Cancellation Policy

Tuskari operates with the following standardized cancellation policy for all safari bookings:

Full Refund Available:

   • Cancellations made 45 or more days before your safari start date receive a full refund of all payments made

No Refund:

   • Cancellations made less than 45 days before your safari start date are non-refundable

   • The operator retains all payments (deposit and any balance paid)

4.2 How to Cancel

To cancel your booking:

  1. Log into your Tuskari account
  2. Navigate to your bookings
  3. Select the booking you wish to cancel
  4. Click "Cancel Booking" and follow the prompts

Cancellation requests are effective from the date we receive them, not the date you decide to cancel.

4.3 Refund Processing

If you are eligible for a refund under the policy above:

  • Refunds will be processed within 5-10 business days of cancellation
  • Refunds will be returned to the original payment method
  • The full amount you paid (including deposit and any balance) will be refunded

4.4 Force Majeure

In the event of extraordinary circumstances beyond anyone's control, full refunds may be provided regardless of the cancellation timeline. These circumstances include, but are not limited to:

  • Natural disasters affecting the safari destination
  • Political instability or government-issued travel warnings for the destination
  • Pandemic-related border closures or travel restrictions
  • War or civil unrest in the safari region

Tuskari reserves the right to determine whether circumstances qualify as force majeure on a case-by-case basis.

4.5 Exceptional Personal Circumstances

In rare cases involving documented medical emergencies, bereavement, or visa denials, Tuskari may review cancellation requests made within the 45-day window on a discretionary basis. Such reviews will be conducted in consultation with the operator, and decisions will be made in good faith but are not guaranteed. Supporting documentation will be required.

4.6 Operator-Initiated Cancellations

If an operator cancels your safari for any reason:

  • You will receive a full refund of all payments made, regardless of timing
  • Tuskari will assist you in finding alternative safari options if desired
  • The operator may offer you an alternative date or modified itinerary, which you are free to accept or decline

4.7 No-Shows

If you fail to show up for your safari without prior cancellation, no refund will be provided.

4.8 Changes to Bookings

If you wish to change your booking dates or details rather than cancel:

  • Contact the operator through the Tuskari messaging system
  • Changes are subject to availability and operator approval
  • Additional charges may apply for date changes, upgrades, or modifications
  • Change requests within 45 days of departure are at the operator's discretion

5. Operator Responsibilities

5.1 Service Delivery

Operators listed on Tuskari are responsible for:

  • Providing the safari experience as described in their listing
  • Maintaining appropriate licenses, permits, and insurance
  • Ensuring the safety and wellbeing of guests during the safari
  • Communicating clearly and promptly with travelers

5.2 Accommodation Substitutions

Operators reserve the right to substitute accommodations with alternatives of similar standard and price if the originally specified accommodation becomes unavailable. This is standard practice in the safari industry and does not constitute grounds for cancellation or refund unless the substitution represents a significant downgrade in quality.

5.3 Itinerary Modifications

Operators may modify itineraries due to weather conditions, wildlife movements, park restrictions, or other operational factors. Reasonable modifications do not entitle travelers to refunds, provided the overall quality and nature of the safari experience remains consistent with the booking.


6. Traveler Responsibilities

6.1 Accurate Information

You are responsible for providing accurate information when booking, including:

  • Correct names as they appear on travel documents
  • Accurate guest counts (adults and children)
  • Dietary requirements, medical conditions, or mobility limitations
  • Valid contact information

6.2 Travel Documents

You are responsible for ensuring you have:

  • Valid passports with appropriate validity (typically 6 months beyond travel dates)
  • Necessary visas for your destination
  • Required vaccinations and health certificates
  • Travel insurance (strongly recommended)

Tuskari and operators are not responsible for denied entry due to inadequate travel documentation.

6.3 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance that covers:

  • Trip cancellation and interruption
  • Medical emergencies and evacuation
  • Lost or delayed baggage
  • Personal liability

Tuskari does not provide travel insurance and is not liable for costs that would have been covered by insurance.

6.4 Physical and Medical Requirements

Some safari activities may have physical demands or health restrictions. You are responsible for:

  • Accurately disclosing relevant medical conditions to operators
  • Ensuring you are physically capable of participating in activities
  • Bringing necessary medications and medical supplies

Operators reserve the right to refuse participation in activities if they determine it poses a safety risk.

6.5 Conduct

You agree to:

  • Behave respectfully toward operators, guides, other travelers, and local communities
  • Follow safety instructions provided by guides and operators
  • Respect wildlife, environmental regulations, and cultural norms
  • Comply with local laws and regulations

Operators reserve the right to terminate services without refund if your conduct endangers safety, disrupts others, or violates local laws.


7. Platform Use

7.1 Account Creation

To book safaris through Tuskari, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Not share your account with others
  • Notify us immediately of any unauthorized access

7.2 Prohibited Activities

You may not:

  • Use the platform for any illegal or unauthorized purpose
  • Attempt to circumvent the platform to book directly with operators after initial contact through Tuskari
  • Post false, misleading, or defamatory content
  • Interfere with the platform's operation or security
  • Scrape or harvest data from the platform
  • Impersonate others or misrepresent your affiliation

7.3 Intellectual Property

All content on Tuskari, including text, images, logos, and software, is owned by Tuskari or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit permission.


8. Liability and Disclaimers

8.1 Platform Liability

Tuskari acts as a marketplace connecting travelers with operators. We are not liable for:

  • The acts, errors, omissions, representations, warranties, or negligence of operators
  • Personal injury, death, property damage, or other damages resulting from safari services
  • The quality, safety, or legality of services provided by operators
  • Disputes between travelers and operators

8.2 No Warranties

The platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.3 Limitation of Liability

To the fullest extent permitted by law, Tuskari's total liability to you for any claims arising from your use of the platform or any booking shall not exceed the total amount you paid to Tuskari for the specific booking in question.

8.4 Indemnification

You agree to indemnify and hold harmless Tuskari, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms and Conditions
  • Your violation of any rights of another party

9. Disputes and Resolution

9.1 Disputes with Operators

If you have a dispute with an operator regarding your safari experience:

  • Contact the operator directly first through Tuskari's messaging system
  • If unresolved, contact Tuskari customer support for assistance
  • Tuskari will make reasonable efforts to facilitate resolution but is not obligated to provide refunds or compensation beyond the terms outlined in these Terms and Conditions

9.2 Disputes with Tuskari

If you have a complaint about Tuskari's platform or services:

  • Not include promotional content or spam

Tuskari reserves the right to remove reviews that violate these standards.


10. Privacy and Data

By using Tuskari, you agree to the collection and use of your personal information as outlined in our Privacy Policy. We collect information necessary to:

  • Process bookings
  • Facilitate communication between travelers and operators
  • Improve our platform and services
  • Comply with legal obligations

10.2 Data Sharing

We share your booking information with operators to fulfill your safari reservation. We do not sell your personal information to third parties.

10.3 Communication

By creating an account, you consent to receive:

  • Booking confirmations and updates
  • Messages from operators regarding your safari
  • Important platform announcements
  • Marketing communications (which you can opt out of at any time)

11. Changes to Terms

Tuskari reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the platform. Your continued use of Tuskari after changes are posted constitutes acceptance of the modified terms.

Material changes will be communicated to users via email or prominent platform notification.


12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United Kingdom. Any disputes arising from these terms or your use of Tuskari shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
